i have a 60 acre farm ....i wanted to sell of 15 ACRES TO JIM....HE WENT AND TALKED TO MARK AND SAID YOU BUY THE WHOLE 60 AND I WILL GIVE YOU 50,000 FOR THE 15 ACRES.....MARK COMES TO ME AND 50, 000 FOR A DOWN PAYMENT AND THE REST ON CONTRACT.....HE WROTE UP A PROPOSAL ( NO AGENT INVOLVED)....AND I SIGNED IT......IT WAS TO BE PAID 9-1-2007....THE LAST WEEK OF AUGUST JIM DOES NOT HAVE THE MONEY.....SO I SAID FINE LETS STOP THE DEAL......MARK DID NOT HAVE THE MONEY EITHER BECAUSE HE WAS GOING TO GET HIS MONEY FROM JIM.......I TALKED TO MARK AND SAID I WANTED TO STOP THE DEAL AND HE SAID I SIGNED A PROPOSAL AND HE IS TRYING TO HOLD ME TO IT.......AT FIRST HE SAID OK AND NOW AFTER 7 MONTHS HE WANTS MY FARM.....NO ERANEST MONEY WAS EVER PAID WHEN THE PROPOSAL WAS SIGNED AND NO MONEY HAS EVER BEEN PAID TO ME ON 9-1-07.....NOW HE SAYS HE HAS THE MONEY AND WANTS TO FORCE ME TO SELL......I DON''T WANT TO SELL THE FARM NOW........PLEASE CAN YOU HELP ME....RUSS GUYER

You said you signed a proposal. Did you complete a contract? An offer and acceptance, or an agreed upon proposal is not the same thing. What exactly did you sign?

I SIGNED A PROPOSAL TO BUY REALISTATE...MARK HAD FORMS THAT HE FILLED OUT,,,,NO CONTRACT WAS EVER DRAWN UP,,,,,,,THE PROPOSAL SATED THAT HE WOULD PAY ME 50,000 ON 9-1-07 AND 10,000 PER YEAR PLUS INTEREST.....IT WAS JUST A PROPOSAL TO BUY....I WAS SUPPOSE TO HAVE A CONTRACT DRAWN UP BUT I WAS DRAGING MY FEET BECAUSE I REALLY DID NOT WANT TO GO THRU WITH THE DEAL.........RUSS

Hello XXXXXXXXX,

That guy is trying to intimidate you. What you signed with an agreement to make a contract. Neither of you fulfilled the agreement (no contract) so tell him to go away and leave you alone. No contract means no valid sale or anything else. I would do this, however--Write all concerned a certified letter and tell them the agreement fell through, you are not selling and leave you alone.
