Question

My ex boss hit and damage my car, he admit it but has not paid. I have ask at least 5 times via email and left message and I spoke with him. The damage total $1,000. I did not turn it in to my insurance because my deductible is $1,000.00. How could I make him pay me? I don't work there anymore and he is avoiding my calls. I am unemployed right now.

You will need to sue him for the damages to your vehicle.

First, send a Demand letter setting for the facts of the case and then giving him deadline for the total amount. Attach copies of what the damage is worth to the letter. Put him on notice that failure to comply by deadline will result in a lawsuit for property damage, including the additional court fees and costs. Save a copy of the letter and send it to your boss by certified mail.

Hopefully with the letter he complies as people hate being sued. If he does not comply with your demand, then you will need to sue him in small claims court and can attach your letter as evidence of your attempts to work this out with him. Make sure to take pictures of the damages to present to the court in case you have to file the lawsuit.

he also owes me $300.00 for 3 days in the office should this be included with the demand for property damage?

No, the $300.00 is a wage claim dispute which you can file with the Department of Labor to assist in the recovery here.

The vehicle damage is a separate cause of action.


They are two separate legal causes of action, not related to each other.
