my father is in a resthome in AR., we the family want to move him to a hospital in LA. Can the resthome stop us from taking him, when I have Power of Attorney/Medical Directive

I live in Ca. but my Dad is in AR. I sent my half-sister to take Dad to the Lady of Lake Hospital in Baton Rouge La., Prissy went in to take him and discovered a gravely sick, She had a fit telling the Staff that Dad was about to have a heart attack, the home called the police and had Prissy escorted off of their property, two days later he had a heart attack the home took him to hospital, when back at the home, a week ten days Prissy went to the home and Dad was white as a sheet, lips dark blue. She had another fit for the home to call ambulance, which they did. Dad has bladder cancer and a history of heart problems, Dad always got treated at Lady of the Lake. Thru the telephone Dad wanted me to get him out of there and I told him the rest home is fighting me on getting him out of there. Dad's reply was "Get a damn lawyer".

Accepted Answer

The only legal way that the staff could prevent you (a power osf attorney) from taking him to a hospital would be if they was a valid concern about elder abuse - in which case they would have been required to contact the appropriate authorities immediately.

It sounds like you need to have him removed from this facility - there is something odd going on, and you don't want your father in a place that would do this type of thing.
