I do not understand. Perhaps my wording of the answer made it not clear.

You asked: is the statute of limitations 4 years or 5 for filing a action for specific performance of a contract for the sale of real estate?

My response was: According to the Pennsylvania commercial code (UCC), the statute of limitations to bring action on a contract of sale is 4 years.

My answer says it is 4 years to bring action....ANY action. Action for non-performance and specific performance, etc.

You have four years by pennsylvani commerical code to bring any action or to enforce the contract, etc.

Perhaps you question is not clear....What answer are you looking for.

Lets me fair here. I have a high credential and am quoting law....perhaps it is not the right question.

I am looking to sue someone for not adhering to the terms of an Agreement for me to purchase real estate in Pennsylvania. I have damages as a result of the individual/corporation not performing, i.e., not selling me the property. In July 2003 he/they would not adhere to the terms of the Agreement. I thought I had 5 years to file under an action for specific performance for damages not 4 years. I apologize for not giving all of the details.

Thank you for the clarification.

My original answer stands, that under commercial code, this type of lawsuit has a statute of limitations of 4 years.

HOWEVER, you do not have to bring suit for non-peformance, you can bring suit for breach of contract.

The statute of limitations for breach of written or sealed contracts is 20 years. (oral contacts, like non-performance is 4 years).
