Question

I signed a contract for a wedding coordinator, With this Ring. Besides her not doing her job, my daughter and I went to a wedding expo to find her there in a booth with different business name. She then explained that With this Ring, Her and her partner dissolved the company and her new co. is Chic details. She stated she will still stand behind the other contract and stated we can sign new contract with her new co. Is this a breach of contract since With This Ring is what I signed up for to do the job. Can I get money back that I paid her, which was $4300.00. I am willing to let her keep a sum for the work she has already done which is not much. Also, the contract only has the wedding coordinators name on it we never signed it. We met in July and is marked pd in full on it. I should state she would also get 10% of any moneys over 30,000.00. We had the dress and reception hall already booked before we met her. Every vendor that she has taken us to has been most expensive.

Dear XXXXXXXXXX,

Unfortunately, there are those coordinators who don't seem to understand how to operate a business. First, you need to read the contract over. It should have a clause in it as to what is non-refundable and what is. (I have a clause that states the 50% deposit is non-refundable)but then I don't collect the balance until the wedding day. I don't understand how you could have paid her without signing a contract.

Start by sitting down with her and talking about your expectations and why you want a refund. Try to keep things on a friendly/professional level. Do tell her what you've said here, that you are willing to pay her for her time already invested - unless that's covered in a non-refundable deposit.

Your other recourse might be small claims court.
When you do locate a new coordinator, be sure to read the contract, ask questions, and don't pay anything without signing the contract.

Reply to Tanya's Post: Because she and her partner dissolved company, doesn't that mean a breach of contract. Since she hadn't notified us of this change wouldn't that mean that With this Ring is unable to follow through with contract since it no longer exists.

That's a good question. I'd have to refer you to an attorney for a sure answer as I don't want to give you wrong information. I'm more concerned with the fact that you paid money and didn't sign the contract.

Obviously it's bad business not to notify current clients of any change in business status.

I would. This way you have some leverage when you talk to this coordinator. That in itself may be enough pressure to get her to refund at least part of your money. It's sad when these things happen.

Actually, this is a question for a local attorney. I'd suggest you call someone locally as I don't know your local laws. Generally they will answer a question without charging you. Try the local Legal Aid.

I will however, pursue your question with an attorney that I know and will let you know asap when I receive her response. It may take a bit of time, but I'll get back to you either way.

This is what my contact had to say:

" I would just tell her that if she wants her money back, she should ask for it. If she can’t get her money back, she should either push forward with the services as negotiated, or move forward in small claims court and/or hire a lawyer to try to get the money back."

But, first try to talk to her about refunding your money. You may end up paying more for an attorney and court costs than you'd lose. (coming from an attorney)
