i breed my dog which was the male and now the other parties are backing out of the verble agreement that i get the pick of the litter.

Generally the sire gets the pick of the litter, equal price to the highest puppy sold, or a flat stud fee. All of this has to be agreed upon before the mating takes place.
The fact that you did not get this in writing may be hard to prove unles you have a witness to the conversation.
