I have a personal injury settlement. I received a bill from an ER doctor and then told him (his collection agency) to get on the lien list and have him the attorney's phone number. I am still receiving notices due from him. Our state also has a 1/3 maximum payout law, I cannot pay out more than 1/3 of the settlement. His fee would put it over the top of 1/3 payout. Do I have to pay him?
JA: Can you tell me what state this is in? And do you have copies of the medical records?

Customer: yes, Ihave records
JA: Anything else you want the lawyer to know before I connect you?
Customer: There may be another claim (the fire department) but I told them also to get on the lien list but they did not.

Thank you for your patience. I want to make sure I understand...the IL statute that applies excludes attorney fees...you mention they are demanding more than 1/3...is that 1/3 after deducting attorney fees?
