My deepest condolences.

You have a case as the surviving family member and representative of the deceased estate.

You can pursue on theory of negligence, breach of contract and wrongful death.

You may seek damages to be determined at trial, and should have a personal injury lawyer make demand first by letter, working on contingency so you have no advance costs or fees. Martindale.com is a good directory for that. Often such cases will settle before trial.
