Missed a small claims date by a day due to stress of our dog

Customer Question

missed a small claims date by a day due to stress of our dog having been operated on for 5 tumors in her head and awaiting news on cancer or not. Do we have a shot at this being rescheduled if a good letter is written to the court?

are you plaintiff or defendant?

what happened? did it get dismissed?

Expert:  Infolawyer replied 1 year ago.

Normally you can file a motion to vacate the default. Alternatively, if you are a plaintiff, you can refile the case.

Kindly let me know if that is clear and acceptable.

You may refile again the case, or file a motion with clerk of court explaining why you missed it.

court will usually grant it. just explain why you missed it in your own words and be apologetic.
