To bring a claim for medical malpractice, you need to be able to show not only that the physician fell below the standard of care, but also that this conduct caused you to suffer damages. The damages need to more than temporary pain or discomfort, but either actual monetary damages or some sort of permanent loss or scarring -- something a jury can put a dollar value on.
