I hope you can help me. This is very complicated. In April of 1998 I started receiving death threats at work. I was the President of the corporation, a 51% shareholder, andI assumed the calls were from a disgruntled employee. However, the calls continued andThe Tustin Police Department eventually tapped 47 phone lines trying to catch three calls from the same number, which is what the phone company required at the time. My son was the VP at the time, 99% of his work was in sales and client services. I ran the office, took care of payroll and generated work queues for the phone techs and created, analyzed and forwarded actuary reports to our clients. I also handled hiring and firing of all employees. My husband had left in Feb. 1998, so when the death threats started in April I felt very alone. In fact, I was terrified. I suffered at the time for fibromyalgia and back pain from a herniated disk. After about a year of threats, I began receiving calls at home too. At that time the Orange County Deputy assigned to my case advised me (off the record) that my panic button to my alarm system would only get them to my home in time to call the coronor while my body was still warm, and that I would be safer with a gun. I attended the proper classes and purchased the gun, but I still could not sleep at night and my health began to suffer because of the toll my nerves were taking on my body. Twice during the following nine months I dressed for work, left my home and remembered nothing until I woke up in the hospital about six hours later. Kaiser did every test they could think of (including drugs) and could not explain why this was happening. When my phone rang on April 7th 2000, at my home, I realized it was the "stalker" and he told me he was glad to see that I had washed out my garage that morning. I remember nothing until later that day when a Deputy knocked on the window of my car at Laguna Beach and told me I had to leave because the park was closing. It was 6:00PM. The last time I looked at my watch it was 10:30AM. I was feeling sicker and sicker and every doctor I spoke with told me I was experiencing a "nervous collapse" during the episodes when I lost time. I was then told my the O.C. Deputy that they could not assure my safety although they were, to their benefit, going so far as to park outside my home at night to do their paperwork in their car, hoping the stalker would be aware I was being protected somewhat. However, my secretary, who was married to a police officer at the time began to notice that not all the callers sounded the same. Some of the voices were young, some were quite a bit older and they said different when compared to the "script" that had been repeated at the beginning. This alarmed the Tustin P.D. because they felt if other men could be talked into making such alarming calls, they might me unstable and decide to impress the origonal stalker and attempt to harm me on their own. As they explained it to me it became a terrifying concept. I decided at this point to move to Mariposa, CA., about 350 miles from my home in Lake Forest, after the Deputy suggested I move at least 100 miles away because, as he said, the is often effective in putting a stop to the threats. I arranged with my CEO to reduce my pay by 2,000.00 per month, and told her I would be taking thirty (30) days off to get my house in order and to purchase a new computer to work from home on. At the time, I spent about six hours per day on the computer and realized I could continue to monitor employees work and due diligence from any distance. I could also generate reports and have clerical mail them to clients as they normally did. My son, the VP, drove the moving vans to Mariposa and helped me get moved in. Less than ten (10) days later I had thrush, a terrible illness that I had somehow contracted from the local water. On the thirty-third day there I swerved to miss a deer and totaled my car on an Oak tree that must have been fifteen feet in diameter. I had seven broken ribs, two black eyes, a broken finger, a broken toe, a broken bone in my knee, and what my doctor referred to as the largest seat belt bruise he had ever seen on a living person. I had been released from the hospital at about 7:00AM, and went home to bed immediately. At around 11:00AM the company VP, my son, walked into my house and, without asking how I was, told me the company would no longer be paying me a salary as they were having financial problems. Also, he added, I had made no arrangement to change my pay scale or to receive payment while living in another county. I was already physically in shock, and by the time he left I was in shock emotionally. Not just because he was someone I had trusted and worked with for nine years, but because he was so cold to me during the conversation. Do not worry. You can resolve this situation and get some peace. You have done all the right things and cooperated with the police. You can sue the stalkers for negligent infliction of Emotional Distress, trespass to land, and harassment. However, you have two years to file a lawsuit for these claims. You will have to argue that your illness prevented you from responding earlier. Get the medical care and mental health counseling you need. Gather all your related medical records and bills. Your case is worth three times your medical bills, mental health counseling bills, lost wages, and relocation expenses. Hire a local personal injury lawyer. Go on www.martindale.com. If I knew who my stalker was, I would have put him in jail. My question is: Do I have any legal right regarding my son talking me out of my stock in my company when I was so
sick? He has never reimbursed me for anything, and we had a verbal agreement that he "would take care of" me. He conned his own mother and I was so sick and heartbroken and suffering from "major depression, recurring" that I could not react to what he had done. I lost everything I owned, including the house that was in escrow.
I need an answer from a legal expert in California. I have just recently starting treatment that has "lifted" the fog from the chemo and fibromyalgia I received. It has taken this long to realize how he victimized me. Please advise. Thank you.
