I worked @ NCO Financial, Inc-20 years. In 2008, my female boss kicked me under the table while at a meeting at a client in Florida. I had a knee replacement on the medial side of my right knee & she kicked me 3 times hard. This was witnessed by my employee. I made pictures that night & also a notarized statement. I wasnt aware at the time I could have filed a police report, but went back later & did. When I got home, I reported my boss, less than a month later (after a stellar career at this company), I was put on a final warning & demoted to a dept I knew nothing about. I also went to my doctor & she had broken a bone in my knee on the side she kicked. She also fired my employee who witnessed the brutal attack. I filed an EEOC claim for the demotion & went to mediation & got a "manager" job at the new dept. I was put in there to fail (my boss was friends with my new boss). They opened a W/C claim, but have never paid. I have continued to get medical care. NCO fired me 10 2009
Optional Information: State/Country relating to question: Georgia Already Tried: Filed new complaint with EEOC for the termination but the W/C case remains open. I have continued to get medical care but they won't pay. I need an atty name or advice on GA law to go against this huge company for what they put me through. My leg is damaged beyond repair and I would need more surgery due to the damage, per my doctor. The lady who kicked me got away with it because I wasn't aware of my rights and didn't even know about the W/C claim until 6 months after they opened it for me. They (NCO) told me in mediation I could continue to see my doctor and submit my bills but they refuse to pay. Please help me go against this horrible company. I was there 20 years and all I did was report a bad manager that other people have had issues with. She even kicked a pregnant woman within the last 3 months.
Hello and thank you for your question. What can I answer for you?
I want to litigate this, I was treated unfairly and want NCO to pay my medical bills and pain and suffering and can the mediation contract I signed be broken? Can I go up against NCO as long as it is before June 2010 for money for the W/C claim?
How much are your damages?
Medical - probably around $8K+Pain/Suffering - $500K
