My husband is a chauffer who works exclusively for one car service in NC. The service says he is not an employee, but rather self-employed. If my husband has an accident while driving one of the service's cars, what liability should be prepare for? I'm convinced the service, the passengers and anyone in the other vehicle could sue him and might even be able to come after our home and other personal assets. If I'm on the right line of thought, what should he do to protect us.
If he is not an employee, he could be sued as you discussed. If he works for the company, does as told, give a w-2, then he is an employee and if he is misclassified should report it to the labor department and the tax authorities.
I asked "what I could do to protect our personal assets" and that part of my question wasn't addressed.
The assets can be put in trust, irrevocable preferably, for your benefit or for the benefit of children, to prtect from creditors
