I am appearing in court on monday for driving while

Customer Question

I am appearing in court on monday for driving while disqualified, but in the statement the last name is ***** ***** therefore I am not the person that was caught driving that day. What are my rights in these circumstances and how do i go about defending myself in court?

Unfortunately that won't be enough for a defence because they will apply to amend as soon as you raise the issue. This does happen and the Summary Proceedings Act gives the judge the power to correct things like this.

You should none the less tell them about the mistake
