if and employee is on maternity leave and wants to return back to salon before the year is up do I as employer have to employ her

If you have sold the salon, then there is no job for her to return to. She is aware that the salon has been sold then I am surprised she is making a claim. But otherwise, if she came back and you negotiated eight hours weekly, and she accepted that, then I cannot see she has any case to claim anything once this elan has been sold. So you should respond to her lawyer by pointing this out.
