Vehicle leaking fuel outside my residence, is this a fault and if so should this vehicle be covered by its current warrant of fitness.

This is definitely a matter where the vehicle may not be roadworthy, because although this isn't a specific criteria for a warrant, nonetheless they would fail it for the dangerous condition. There is also the aspect of pollution, which can be criminal, but is certainly contrary to your local council bylaws, as this will leak into stormwater.
