This answer was rated:

Is a permanent visa holder of newzealand going to be denied of entry in nz when he unfortunately commit an criminal offense during the time he went back to his home country?" He might been sentence to imprison for 2 years, and it doesn't take effect until 3 years later. That means he will be in prison in three years. However, if he behave good he normally will not been in prison at all. So does he fall in the extent of nz bord act" sentence to imprison more than 12 months..."? Tks

christhelawyer : HiWelcome to JustAnswer. My first response will follow shortly. Please feel free to follow up if anything is not clear
christhelawyer : From your description this is what is called a suspended sentence. The person has not actually been given a jail sentence but a threat of one. What are the terms of this? When can they make him actually go to jail? What does he have to do to avoid going to jail? What was the crime, just a general description such as fraud or something?
Customer: Tks for your reply. The case hasn't been confirm yet. Just has the possibility to be suspended sentence. If within 3 years no more bad behavior he need not be in prison ar all. The fact is he did not have any intention to commit a crime. He is the supervisor. His staff fight with other people and use explosion that cause death.
christhelawyer :

This sounds like an occupational safety and health in employment matter. It may not affect his visa however if he is not jailed

Customer: Is the suspended sentence counted as in jail if being sentence to "2 years jail but wait for 3 years?"
christhelawyer :

It si a jail sentence only if he has to serve time in jail

Customer:

he has ever been wanted as the staff push all the responsibility to him. however, the later proof all shows that he has no intention to harm anybody. on the contrary , he has proof to stop the fight. is this going to affect his entry as he ever been wanted?

christhelawyer : Only a sentence of jail would stop him
Customer:

thank you . very helpful.
