It is not illegal but if they want to refer to the telephone conversation in court or in some similar type of proceeding, you can raise the issue of fairness in making the recording, and sometimes the evidence of the call cannot be used or referred to if this was unfair. However the Privacy Commissioner does recommend to telesales organisations that they record such calls.
