Hello, my wife left me left me on 5 August, while I was away in the UK on business. I'd like to know if she's entitled to half of my fathers estate, who died 1 March 2011 leaving money and property to my sister and I, but as the will was contested it still hasn't been settled yet?Many thanks,Russell

Generally an inheritance is separate property and here because you have not actually received anything yet, it will remain separate. It only becomes jopint when you mix it with relationship property
Thank you for the answer. My wife has stated that she "paid half of the lawyers bills during the settlement of the Estate", meaning that we were still together at the time the will was contested and incurring legal expenses. Does that change your answer above?

Thank you. Included in my inheritance was a forgivable loan of $60 000 which we used to buy silver bullion two year previous. I returned home to find that she had moved out taking half of the silver. Is this classed as relationship property or my inheritance?
That gets more complicated because if you used this loan for family purposes then it would become relationship property and she would be able to take half
