Do you know New Zealand criminal law?
I would like to know about civil and criminal responsabilities of the owner of a car that borrowed it to an unlicensed driver, and the car was involved in an accident causing damages to the car, and to another car and person, in New Zealand.The owner has insurance, but of course the driver who borrowed the car is not one of the nominated drivers.

If someone borrows a car, with the consent of the owner, and causes an accident and damage, both are liable for the damage in the civil courts. The driver is because he caused the accident, and the owner because the driver was his agent.
As for criminal responsibilities, the driver would be liable to be prosecuted for careless driving for the accident, and driving without a licence. The owner could also be prosecuted for permitting the unlicensed driver to drive the car.
