We sold a vehicle to a person who has not paid in full yet and now has shifted without leaving a ;forwarding address. We have found out where he lives and after talking to him he still has not made any more payments. What is our legal rights? Can we go and repose the vehicle?
Already Tried: Ringing him, As we only had a cell phone number for him. We now have his address, but havent told him we have it. We didnt want him shifting again.
Hi Welcome to JustAnswer. My first response will follow shortly. Please feel free to follow up if anything is not clear
You can only repossess if you have a security registered against the car under the Personal Property Securites Act. You can still register such a security which may stop him selling the car. If anyone wants
to buy the car they will see there is a security and it will stop him being able to sell the car. If he is refusing to pay the remaining money and claims a dispute you could then claim in the Disputes Tribunal.
