Can military retirees own or invest in a cannabis business

Customer Question

Can military retirees own or invest in a cannabis business in states where cannabis is legal without fear of being prosecuted under the UCMJ and losing retirement pay and benefits?

Thank you for your question. I look forward to working with you to provide you the information you are seeking for educational purposes only.

Actually, if the person is a military retiree, there is no prohibition from them investing in marijuana growing businesses or dispensary businesses. The retiree could not be prosecuted under the UCMJ for this investment. The federal government might pursue regular criminal prosecution, because it still is illegal under federal law, but those prosecutions in states where marijuana is legal has been very rare. You would not lose your retirement and benefits though over this.
