While married, my husband spent 6 yrs active duty and finished to 20 yrs in the reserves. We divorced 2 yrs ago. My divorce settlement says I am entitled to 50% of his Retirement pay. If I remarry will I still be entitled to this 50% of his retirement pay?
Thank you for your question today, I look forward to assisting you. I have nearly 20 years of legal experience in various disciplines, including JAG.Nothing in military law invalidates that court order simply because you remarry. If the court order states that Remarriage nullifies it, then yes it would, but otherwise remarriage has no effect on the 50% order.
Lawyer and current JAG officer.
