Do I need a Military Lawyer for a federal civilian (FERS) debt with DFAS? They claim they over paid me 12,000 while on Active duty from Oct 2011 thru Sep 2003. My wife and I never received any other check other than my active check 1st and 15th of the month. They cannot come up with a leave and earning statement only some time cards filled out by someone within my wing as if I was there. The did not even know I had a debt until I retired from the Air Force in April 2011 and turned in my DD Form 214. They also came up with a supposed old routing number from wells fargo that the bank has no record (too old) of receiving any money in to.
Thanks for the chance to help. I am an attorney with over 12 years military law experience.I want to make sure I understand...they claim you were active duty at the same time you were drawing FERS benefits? And that is not accurate?
I was an Air Force Technician working for the Air National Guard when called for Active Duty for 9/11. In order to hold a position with the federal gov't u must be a member of the armed forces. Civilian during the week and reserve or guard the one weekend a month. Although required to where the uniform everyday. esentially full time Air National Guard.
Thank you But I am not sure I understand...you were collecting FERS benefits AND drawing fully time duty pay?
That's what DFAS is claiming and only have time sheets that incidently were not coded correctly being turned in while I was on active duty for civilian pay. We are saying we never received this money. My W2 do not show receing this money.
ThanksI do not know the answer to this question, but will opt out and allow other experts to assist
You not knowing the answer is not the answer I was looking for and am not satisfied with that. I need to be satisfied with my question before you collect the remaing $29.00
