An old urinalysis test from 9 months ago was just brought up to my Co. Had an appt with ASAP and i tested positive for methamphetines. I was just recently put on my medication that does have that chemical in it. I never even knew what my medication was until the Army proscribed it to me and now there saying i took it 9 months ago when i was in a different unit and duty station. My question is, can they councel and implement ucmj even though its been 9 months since this UA was taken and nothing was ever brought up until now?

I have nearly 20 years of legal experience in various disciplines, including JAG.Yes, they can. 9 months is quite a delay, but it doesn't go over the statute of limitations for non-judicial punishment or Court Martial and there is no statute of limitations for counseling or administrative separations.The delay will not stop them from taking action.
