A husband is in the military for twenty (20) years. He was married to Wife for eighteen (18) of those years. What health insurance benefits, if any, is Wife entitled to?

I have nearly 20 years of legal experience in various disciplines, including JAG.With those figures, she would not be able to meet the 20/20/20 requirement. Not enough of her Marriage overlapped military service.She would only be entitled to 20/20/15 treatment (if they marriage lasted 20 years or more) which means one year of transition insurance.

I have more details about the marriage now... Husband and Wife are married for 19 years and 1 month. (October 1988-November 2007)... Only during 18 of those years did the Husband serve in the military. Is Wife entitled to any health insurance benefits?Any statutes or case law that will help?Thank you

I'm sorry. I wasn't present when you asked the follow up.She would not meet the 20/20/15 rule, because they were not married for at least 20 years.She would not be entitled to any insurance continuation. Not even the one year transitional type.
