I have been receiving ss disability and 3/4 disability due to 9/11 injuries since 2006. My tax preparer didn't seem to realize that my ss and pension are tax exempt Since they happened related to 9/11 terrorist act exemption. I am a retired FDNY firefighter. When I brought to her attention she amended past 3 years and said that all other years were done right. I checked and it was not true. I was taxed for first 5 years of my ss disability in excess of 13k lost. How can I recover $. Do I have the right to sue? In 2010 I didn't bring my ss info on tax day since I believe someone fellow retirery had mentioned to me it was non taxable so I left it at home. A year later the IRS sent me a letter saying I was missing my info and owed 2500 in taxes I sent the letter to my preparer and needed ss info and she told me to pay it and I did. I had told her at the onset I thought I didn't have to pay taxes on my ss . Since those returns from 2010 were amended in 2012 incorrectly can I amend again past the 3 year limit since they were amended in 2012? Is this considered incompetence.
