Hi Loren! One more question....we sent our tenant a letter..giving him 5 days to get the rent to us and we specified the rent amount or else we'd start an eviction process. Well, on day 3 we received a check...one dollar short from what we indicated he owed us in the letter...and was his previous amount of payment. Initially we agreed upon and amount (Monthly) then he wanted to expand the cable service, so we let him take that over..he then deducted what we had ben paying for the basic service from our monthly rent. We let it go...was ok. But now he sends us a check, one dollar short! Our interpretation is that he did not fulfill the requests in our 5 day notice...are we right? Do we really have to wait 30 days to get the court involved?

If you accepted a "partial payment" without a partial payment agreement (you were not legally required to accept a partial payment) then you will need to give another 5 day notice. Though it seems a bit silly to go to the expense and trouble of an eviction for $1.
