Customer Question

In the state of Utah, does a wedding venue owner whose venue is also their home, who holds a home occupation business license, have the right to refuse to allow same sex marriages to take place in their venue (home) because of personal religious beliefs? And would those rights be any different if they were a non profit organization, 501C3, rather than a business?

Thank you for your question. I look forward to working with you to provide you the information you are seeking for educational purposes only.
Actually, the UT law protects individuals from discrimination in housing and employment, but does not mention anything about the rights of businesses to conduct business with individuals based on their sexual orientation. The UT law also carves out an exemption to allow persons to act based on their sincerely ***** ***** beliefs (they must prove the belief is a recognized belief of their particular religion).
The rights would be the same for a non-profit or a business. If they were a non-profit religious organization then they could also be exempt from the employment and housing discrimination in the law based on sincerely ***** ***** beliefs.
