You need to file an appeal of the denial of claim. By law, the insurance policy must include in its terms the procedure (notice, time limits, arbitration, etc.) for the appeal of a denial.
Check the policy and file your appeal. Make sure that you comply with the provisions to the letter regarding deadlines, notice, transmission of the notice, etc. Failure to follow the instructions in the policy could prejudice your right to appeal.
If the appeal is denied you can then sue for bad faith if the denial of claim is unlawful. If you prevail in a bad faith claim you can be awarded punitive damages and attorney fees.
