Can I get a lien if I have a fully executed promissory note

Customer Question

Can I get a lien if I have a fully executed promissory note (with two signatures)? I have loaned someone almost $50K and it is payable upon the sale of property (which is stipulated in the note). They have yet to put the property on the market, as agreed
JA: Because laws vary from place to place, can you tell me what state this is in?
Customer: NY
JA: Have you talked to a lawyer yet?
Customer: No
JA: Anything else you think the lawyer should know?
Customer: She's my mother

You will need to file a lawsuit and get a judgement before you can put a lien on the property.
