Ask a Lawyer and Get Answers to Your Legal Questions
Hi and welcome to JA. Ray here to help.It would be better for tenant to waive right to jury trial here.
You have to understand the courts decide whether the waiver is enforceable or not if it comes to eviction or other court actions. But you would want them waiving their rights here not you as landlord.
I appreciate the chance to help you today. Thanks again.
You do not want to waive anything. If you can have tenant waive their rights it is better for you. Then you control the issue rather than tenant, again if the court upholds the waiver they sign in the lease here.It is worth a try to have it in writing.
