When my husband died (this was second () marriage for both of us he did not leave me any thing. He owned the house we lived in and stated in his will that I had property of my own and that I would have days to move out of the which he left to his son . Sixty days. Was this legal?

The estate has been settled. He died Feb 27th .at the time of his death I was living at an assisted living facility because I had had a bad fall and he did not think he could take care of me at home. We were NOT SEPARATED. Just not living together at the time but I would gone back home when I got better.

Thank you for your question.

According to

http://www.hg.org/article.asp?id=29284

you still own your half of the community property.

Has the Will been filed for probate in Court?

If so, has an executor been appointed?
