By default an inheritance is treated as 'separate' property and not as community property. It is only community property if the inheritance is placed into the community property with the intent to share it. For example if one party receives a $50,000 inheritance and places the funds into a joint account, arguably that amount becomes community property. Similarly if one spouse inherits a property, and places the other spouse's name on title, it becomes community property in the process.
