Ex spouse would like me to be a guarantor on an apartment

Customer Question

Ex spouse would like me to be a guarantor on an apartment lease in NY state. Would /could acting as a guarantor be construed as providing "spousal support" ? Both of us have waived spousal support in marital settlement agreement. I am wondering if this
could create some issue if I acted as guarantor (eg even though settlement agreement waived spousal support by both parties would acting as guarantor imply "spousal support" and hence become a potential basis for spousal support or is it a non issue?)

Thank you for your question. I look forward to working with you to provide you the information you are seeking for educational purposes only.
Acting as a guarantor is not providing spousal support. If you decide to co-sign a loan or be a guarantor for an ex spouse after marriage that is just a gratuitous act you are engaging in. It is not spousal support or alimony.
