It is against the law to possess any drug requiring a prescription if you do not have a legal prescription for that drug. Non-controlled substances requiring prescriptions are called "legend drugs," and possession of a legend drug without a prescription. The penalty for violation of the laws dealing with legend drugs is found in Tenn. Code Ann. § 53-10-108. This section provides that “[a]ny person, firm or corporation possessing, selling, bartering or giving away any drug in violation of this part or violating any other provision of this part commits a Class C misdemeanor
. The penalty is up to 30 days in jail and a fine of up to $50. It is also a misdemeanor under th Federal Drug Control Act punishable by up to 1 year in jail and up to a $2000 fine.
