This answer was rated:

My boyfriend was arrested Tuesday night around 10:00 and still has not gone before a judge , been formerly charged, or been offered legal council. His bail was set at $75,000. We are in Nebraska. How long can they make him wait for legal council or to be charged?

Thelawman2 :

The right to speedy trial dictates that a person held in custody must be charged or released within 72 hours

Customer: Ok
Customer: and he doesn't have a right to a lawyer during that time?
Thelawman2 :

No he does not, he only has a right to an attorney when he is formally charged at an arraignment hearing

Customer: So if he doesn't have an arraignment tomorrow he will be released?
Thelawman2 :

Correct, or else they would be violating his constitutional rights

Customer: Ok. Thanks. We will see what happens
