This answer was rated:

In creating a Durable POA to cover my brother who is borderline special needs, 68, and becoming more unable to manage his affairs, if I prepare online docs for a POA, stating that he resides in Kansas, can he sign the docs here in South Dakota upon his upcoming visit ... notarized and witnessed in South Dakota even when he resides in Kansas?

RayAnswers :

Thanks for your question and good day to you.Yes you can have him sign it and notarized there in South Dakota while he is present there. This is not a problem to do so.

RayAnswers :

Here are the Kansas POA laws for reference.

RayAnswers :

If you are trying to use this for business in Kansas here where he lives you do a Kansas POA but modify the notary signing to South Dakota.

It's necessary to use the Kansas POA then ... and if business is also in South Dakota, then another POA form is necessary?

RayAnswers :

You may need two of them here if you need to do business in two states, each one meets that states requirements.
