Hello again,

In Texas, the Justice of the Peace Court in eviction cases does not require notice of a Motion for Non-Suit.

This is because the motion of non-suit must be sent when/if the Defendant (i.e. you) has a counter-claim against the Plaintiff. In an eviction suit, a Defendant cannot file a counter-claim against the landlord.

As such, most JP Courts will accept and non-suit a matter without the need for notice and a hearing.
