To be more clear I mean emotional abuse that resulted in her bones not developing correctly due to lack of nourishment

Emotional abuse as a cause of action does not exist--you either can pursue claims for sexual abuse or physical abuse. If her bones did not develop correctly, that is physical abuse (as physical abuse can be indirect, as in this case based on an argument of neglect rather than abuse outright). A neglect case is generally a misdemeanor. Such misdemeanors have an 18 month statute of limitations but can be extended by 5 years if the actor is absent from the state.
