Well okay you stated that the statute of limitations was up, but based on what I told you would I have had a case if I had persued it in a timely manner?
I think so. You told the broker to sell the stock and get it into cash. He failed to follow your directions. He's bound by his contract with you and the law to follow your directions. He violated these duties by not doing as you directed and this resulted in a loss to you. That's a good lawsuit.
