In Mississippi, is a 30 day notice of foreclosure adequate to the debtor under the FDCPA? I have heard that this may have been recently extended to 45 days.

Good morning. I believe you are referring to Bill 2897, which requires 45 days notice instead of 30. Here are two links, which you can review, that disclose what the lender must do, prior to initiating foreclosure against a homeowner.

If the lender fails to comply with said requirements, they may not be able to proceed with the foreclosure and the borrower could have a defense to raise, to stay the proceedings.
