Subpoena was issuded and delivered by certified mail today. I am currently visiting Japan that my son-in-law signed and received the mail. Plaintiff requested my personal appearance on her civil case against her husband. Since I am oversea right now, and the court requested me to appear on next Tuesday (and today is Friday in Japan time) that it is no way possible for me to be there as commanded. Plus, there are some inaccuracy and unclarity in the letter that I am uncertain that this subpoena is served as legitimate claim. Do I absolutely have to appear to the court? What appropriate actions do I need to take?

Hello and welcome,It would normally have been better if the family members were instructed not to sign for anything for you, but since they did, you will likely need to retain a MD attorney to file a motion to quash the Subpoena if the party who issued it will not agree to withdraw it since you cannot possibly comply with the order at this time. You could first contact the issuing attorney and see whether they are willing to come to an agreement with you. If not, then an attorney will be necessary to represent you and file a motion with the court since you could be held in Contempt of Court and a warrant issued if you simply ignore it and do not appear as demanded. Here is a link to MD attorney referral services:http://www.msba.org/public/referral.asp
