Hello,I have reason to believe that my ex-wife opened up a line of credit with a television shopping network using my daughters name and social security number. My daughter is 20 years old so not a minor. I believe the credit line opened was for $1000 for which the account is now at it's limit. It appears that my ex-wife made minimum payments on the account so the account is not in default but it remains at it's maximum limit. Since the account is max'ed out my daughter's credit score is lower because of it.Do I have any legal recourse in this matter, on behalf of my daughter, if my daughter chooses to not take any legal action against her mother? This information was conveyed to me via my daughter so as a concerned father is it entirely up to her to take or not take action or do I have any ability to take legal action on her behalf?Thank You.
That is considered identity theft, but your daughter being an adult has to file the complaint with the DA's office for investigation. Your daughter can get a free copy of her Credit Report and this account would show up on there to show whether or not the account was opened. If your daughter chooses to take no action, as she is the victim, that is the end of it and you cannot take action because she has to be the one to claim it was a theft of her identity and if she doesn't then she will be liable for repaying the money if it is not repaid.
