I was sent a letter from a Law Firm because they rec'd notice that a judgement was being filed against me. I contacted the office and had an initial consult. I never got to speak with the Lawyer himself but the fellow talking with me seemed very knowledgeable. On the way home, a few more questions popped up that I wish I had asked before signing the retainer fee agreement. How did they even get my information, why were they the only ones who got it. He knows the attorney of the collection agency that is suing me. Suddenly I feel like they are in cohoots with each other. Could that be; might I be getting scammed here? If the lawyer can't get my case settled or dismissed and I still receive a judgement, will I get my retainer $1795 retainer fee back?

It is possible they could be in cahoots but incredibly unlikely. This is something you hear people complain about all the time but I have never, ever seen a case where it occurred. It's not worth risking your law license over a couple of thousand dollars. If you don't mind, I am still curious why I only received a solicitation from one law firm. If my name and situation was released from the court house to law firms, why would only one send out a letter, unless they were the only ones to receive my info. Makes me think that the attorney representing the collection agency personally called this attorney I signed an agreement with and gave him my info. Whenever I or anyone I know has received a speeding ticket for example, we always receive countless solicitations from various traffic schools.
There aren't a lot of law firms that do debtor defense because most people that are pretty far along in a case without a lawyer aren't going to hire one so you have to send out thousands of letters to get clients and most lawyers don't do it. It's different with the other types of cases.
