can we take someone to small claims for selling us car that said it had new rods and on the way home it threw a rod. he said as is but he would fix a oil leak and it was not fixed.

Was the rod in question an old rod?

You can sue in Small Claims only if you can get proof from your mechanic that the rod in question was NOT new as the seller claimed. Then you can successfully sue on the grounds of Breach of Contract and fraudulent inducement to contract.
