Ok, my friend has gotten his plea bargin and will be incarrcerated for a few years and has asked me to become his power of attorney. How and where do I go to get that done, and can he sign the paper work in jail if I send them to him?
Optional Information: Country relating to Question: United States State (if USA): Texas Already Tried: I'm in Texas, hes in West Virginia but will be in a federal prison in Texas after he gets sentinced.
Thanks for using Pearl.com It will be my pleasure to assist you today. What type of Power of Attorney does he want you to have? For what purpose does he want you to have a power of attorney? 1. A medical power of attorney to make decisions on his behalf if he cannot make them?2. A power of attorney over his finances--bank accounts, sell property, cash checks, etc. Thanks
I'm sorry I should have been more clear, he wants me to be the power of attorney over his finances and personal property.
Hi Veronica,Thanks for the information. It will be much easier if he waits until he is in Texas to give you Power of Attorney.Below is a link to a sample of a Statutory Power of Attorney. It is a link to an attorney's office. I am NOT making a referral. However, it is a sample that you may re-type and send to him once he is in Texas. Please note that he must sign the Power of Attorney in front of a Notary Public. There should be a Notary available when he gets to the Federal Prison in Texas. Once he signs the Power of Attorney, he can keep a copy but you must have the original Power of Attorney so that you can handle his financial affairs.http://www.texaswillsandprobate.com/POA.htm
