On the 9th of this month. I took my daughters car to jiffy lobe to get the oil changed. I had got up at 3am that morn. So I was pretty tired. Im 73 years old. I got the oil changed. They thought I was drunk. A cop came and checked me out. I was not drunk. So I told them I was going to sue. Thats when all kinds of stuff happened to me. I have not seen an attorney as of yet. Do I have a case?
Thank you so much for this opportunity to try and be of service to you today.
Wisdom...compassion..empathy. These are more than words for me. They are my promise to you.
I am a licensed attorney and will do my best to provide you an honest and accurate answer to your important legal question.
QUESTION: "Do I have a case?"
ANSWER: First of all, please allow me to take a moment and say that I am genuinely sorry for all you have been through with this ordeal. I mean every word of that, and I deeply regret the obvious serious obstacles occasioned by this situation. Here is how this works. This type of cause of action alleging an unlawful deprivation of civil liberties by one acting under color of law is governed by 42 U.S.C. § 1983. To see if you have viable grounds for filing suit, you must have your case screened on the merits by a plaintiffs' trial attorney. If an attorney accepts the case pursuant to the customary contingency fee agreement there would be no up-front charges to you. Rather, your legal counsel would only get paid out of the proceeds of a verdict or settlement if he or she were successful in obtaining a favorable outcome and winning the case on your behalf. This can only be done through having a lawyer review your circumstances, meaning it cannot be done in this online informational venue.
I truly hope all works out for you.
