My husband hacked into my gmail account. Not on my home computer where I never use it. From a third party system. How do proceed to begin charges:?

If your husband hacked your account, you have a right to file a criminal complaint with your District Attorney's office and also the local FBI office computer crimes unit. You will need to present whatever evidence you have of the hacking to the DA when you file your complaint and they can Subpoena whatever information that they need that you do not have. If you just go to the police, most local police agencies are not equipped to handle complaints of this nature.

My "evidence" is that he admitted verbally that he has been reading my gmail for several weeks, including a work project that I've stored there to which he should never have had access. When I told him it was a felony, he came back hours later saying "maybe I accessed it through your phone or laptop." which is impossible since both are immediate pass locks and were with me on a recent trip where he admitted he was "tracking" me via gmail. Is that enough to charge him? Or do I need it on video?
No you do not need it on audio or video, it would help, but it is not necessary. The DA or FBI can subpoena the email account records to try to determine the access IP addresses to determine if they can put enough evidence together to tie it to him.
