The customer can sue for negligence if the artist's work was below the standards of a tattoo artist with the similar training and expertise. You would need to get another artist to review the work and testify as to the negligence of the artist. If the artist tattooed something bad on purpose, then it could be a suit for intentional battery. The customer can seek damages including pain and suffering and any costs for removal of the tattoo
